Term. This Boat Slip Agreement is for the period of June 1st, 2025 through October 15th, 2025 inclusive, after which time, if not sooner terminated, it may be renewed at the then posted or negotiated rate for such additional period as the parties may both further agree in writing after payment of all the due fees and costs. Rents. Tenant shall pay when due all rental amounts under this Boat Slip Agreement as set forth below (the "Rents"): Slip Rates: Standard Rate (no electric): Electricity: $250 flat additional rent $40/ft. (27 ft. and under)Boat Length(Required)Total Rents for the Term:(Required) Payment terms: 50% due with signed contract, remaining balance by July 1st, 2025. After July 1st, all seasonal slips will require full payment at time of contract signing. Default. If the Tenant fails to timely pay all Rents, or is in any other way in default of this Boat Slip Agreement, the Marina shall have all remedies set forth in paragraph 8 set forth below in addition to all such other remedies available to it under. Sublease. Tenant agrees not to transfer, sublet, assign or permit the use of their slip by any other personal or vessel than described in section 1 above. Removal of Vessel. Tenant shall not have the right to remove the boat from the rented slip or the location to which the Marina has relocated the vessel herein under, until all costs and fees described in this agreement have been paid in full. Tenant agrees that the Marina may process a New York State Mechanics Lien on the vessel for unpaid rent, dockage and other services provided by the Marina. Rules and Regulations. Tenant agrees to be bound by the current Marina Rules and Regulations adopted by the Marina and in place during the terms, as the same may be amended from time to time. Marina Rules and Regulations shall be made available to the Tenant upon request. Foul Weather. Tenant agrees that it is not relying in any way upon the skill or intervention of the Marina to protect the vessel should foul or dangerous weather threaten to damage, or damage the vessel. Tenant agrees to secure their vessel with half inch (.5”) dock lines or better. The Tenant agrees to supply adequate fenders (bumpers) of no less than eight (8) inches wide while moored on any floating dock. The Tenant agrees to hold Marina harmless, indemnify and defend marina from any claims of any other owners of property or vessels at the Marina facility arising out of contact with the Tenant’s vessel, and further agrees to be responsible to Marina facilities or property arising out of contact with Tenant’s Vessel or any fuel or appurtenance there from, including, without limitation, dock damage, environmental fines and other liabilities. Termination. Termination by Tenant: Tenant may terminate this Boat Slip Agreement at any time. Notwithstanding any early termination, Rent for the Term shall not be prorated and the marina shall not be obligated to return any portion of the Rent remitted. Early termination of this Boat Slip Agreement shall not terminate Tenant's obligation to remit the Rent. Termination by Marina: For cause: The Marina may terminate this Boat Slip Agreement for cause if the Tenant violates any terms or conditions. Termination may occur upon three (3) days actual notice or ten (10) days written notice posted onboard. Not for cause: The Marina may terminate without cause, at any time, with ten (10) days written notice. Rent will be prorated and any surplus returned. Removal: If the Tenant fails to remove their vessel and equipment: Remove and re-dock the vessel at Tenant's expense. Lock the vessel in place until payment is made. Charge transient daily rate until paid. Renew rental at current seasonal rates. Exercise any legal or equitable right. Use any combination of these remedies. Security for Rent: Tenant may not remove their vessel until all fees are paid in full. LESSEE AGREES THAT ALL CHARGES ACCRUING UNDER THIS CONTRACT SHALL GIVE LESSOR AN EXPRESS LIEN UPON LESSEE'S CRAFT. Tenant also agrees to pay legal and collection costs. Tenant Acceptance. Tenant accepts the Slip and premises "AS IS" with all faults. Tenant waives all warranties and agrees to maintain the condition, remove refuse, reimburse for damages, and not make alterations without permission. Improvements become Marina property unless removed and site restored by Tenant. Indemnity. Tenant agrees to indemnify and hold harmless the Marina, its officers, agents, and employees from all claims or liabilities due to injury, death, property damage, or environmental damage caused by the Tenant or the Tenant's boat. Insurance Coverage. Tenant must maintain liability insurance with a minimum of $150,000 coverage. Proof of insurance is required before the term starts. Entire Agreement. This is the complete agreement. It can only be amended in writing signed by both parties. No Assignment. Tenant may not transfer, sublet, or assign the slip to anyone not listed in the agreement. Choice of Law and Forum. This agreement is governed by New York State law, with disputes resolved in Cayuga County courts. Severability. If any part of this agreement is invalid or unenforceable, the rest remains in effect. Binding Nature. This agreement is binding on the parties and their heirs, successors, and assigns.
